The Ministry of Industry and Information Technology, the National Development and Reform Commission, and the Ministry of Natural Resources have issued the "Interim Measures for the Total Control and Management of Rare Earth Mining and Rare Earth Smelting Separation." The interim measures stipulate that rare earth production enterprises that violate the provisions of these measures or refuse to cooperate with supervision and inspection departments in carrying out their duties shall be ordered to make corrections by the competent industrial and information technology, natural resources authorities of the people's government at county level or above, and shall be punished in accordance with the "Mineral Resources Law of the People's Republic of China," the "Regulations on the Management of Rare Earths," and other laws and regulations. Rare earth production enterprises that receive administrative penalties for violating these measures shall have their total control indicators for the next year reduced. Personnel from the competent departments of industry and information technology, natural resources, and development and reform who abuse their powers, neglect their duties, or engage in malpractice in the total control and management of rare earth mining and smelting separation shall be disciplined in accordance with the law. Violations of these measures that constitute violations of public security management shall be subject to administrative penalties in accordance with the law; those that constitute crimes shall be held criminally responsible in accordance with the law.
