Three departments: Business operators within the platform selling goods or providing services on different platforms are allowed to autonomously set prices in accordance with the law.
The National Development and Reform Commission, the State Administration of Market Regulation, and the Cyberspace Administration of China have issued the "Rules on Internet Platform Pricing Behavior". The Rules stipulate that operators within the platform can independently set prices for goods or services sold on different platforms in accordance with the law. Platform operators shall not violate Article 35 of the Electronic Commerce Law of the People's Republic of China by taking measures such as increasing fees, adding fee items, deducting deposits, reducing subsidies or discounts, limiting traffic, lowering search rankings, algorithm downgrading, blocking stores, delisting products or services, etc., to impose unreasonable restrictions or attach unreasonable conditions on the price behavior of operators within the platform, such as: forcing or indirectly forcing operators within the platform to reduce prices or engage in promotions through profits or rebates; forcing or indirectly forcing operators within the platform to sell goods or provide services on the platform at prices no higher than in other sales channels; forcing or indirectly forcing operators within the platform to open automatic pricing, automatic price reduction, or similar systems; and other behaviors that restrict the operators within the platform from independently setting prices, except for platforms with a unified pricing model implemented by platform operators.
