The regulations on personal bankruptcy have been implemented in Xiamen.

On the 26th, the 31st meeting of the Standing Committee of the 16th Xiamen Municipal People's Congress voted to pass the "Xiamen Economic Special Zone Personal Bankruptcy Protection Regulations." According to the regulations, natural persons who have resided or engaged in production and business activities in the Xiamen Economic Special Zone for a continuous period of five years, who are unable to repay their due debts, and whose assets are insufficient to repay all debts or clearly lack the ability to repay, can undergo reorganization, reconciliation, or bankruptcy liquidation. If a debtor falls into the aforementioned situations, they can apply for bankruptcy to the court; if a debtor cannot repay their due debts, individual or aggregate creditors holding claims against the debtor exceeding five times the previous year's per capita disposable income of residents in this city can apply for bankruptcy to the court. This is the second local regulation on personal bankruptcy in China following the "Shenzhen Economic Special Zone Personal Bankruptcy Regulations." The regulations are the first to include "protection" in the title, aiming to standardize the personal bankruptcy process, fairly clear debts and liabilities, protect the legitimate rights and interests of creditors, debtors, and other relevant parties, and promote the economic revitalization and reintegration of honest debtors into society.
