Low-frequency noise from shops disturbs residents and is held accountable: The first case under the Environmental Protection Code is ruled.
On August 15, the second codex of our countrythe "Ecological and Environmental Code of the People's Republic of China"officially came into effect. On that day, the first case in China to be adjudicated under the Ecological and Environmental Code, concerning noise pollution liability, was heard in the People's Court of Qujiang District, Quzhou City, Zhejiang Province, and was immediately ruled upon, marking the "first case" in judicial practice under the new law. The court, based on the relevant provisions of the "Ecological and Environmental Code of the People's Republic of China" and combined with evidence such as on-site investigations and medical records, rendered a judgment on the spot according to the principles of economic efficiency and damage minimization: the defendant was ordered to undertake noise reduction and vibration mitigation rectifications within a specified period, as well as to compensate the plaintiff for medical expenses and mental anguish.
