Supreme Court: When trying cases of minors "recharging" and "rewarding", all factors should be fully considered and a comprehensive judgment should be made.
The Supreme People's Court issued guidelines for the trial of civil cases involving minors on March 18. The guidelines clarify that when handling contract disputes involving minors as parties, such as in-game recharging and live streaming rewards, courts should consider the nature and content of the specific contract, the extent to which the contract is related to the minor's life, whether the minor can understand their actions and anticipate the consequences, as well as factors such as the subject matter, quantity, price, or compensation in the contract, comprehensively assess whether the contracting behavior is appropriate for the age and intelligence of the minor, and confirm the validity of the contract. In cases where parties seek restitution or compensation for an invalid contract, they should be supported; in cases where parties seek compensation for losses, factors such as the age, intelligence, contracting process, and performance of guardian responsibilities of the minor should be considered in determining the faults and corresponding responsibilities of the parties involved.
