Tianjin Issues Document to Promote the Implementation of Paid Annual Leave System

Recently, five departments including the Tianjin Municipal Human Resources and Social Security Bureau, the Municipal Federation of Trade Unions, the Municipal State-owned Assets Supervision and Administration Commission, the Municipal Federation of Enterprises, and the Municipal Federation of Industry and Commerce issued a notice on the implementation of the paid annual leave system, promoting the full take of entitled leave and guiding staggered vacations. The notice states that employees who have continuously worked for more than 12 months are entitled to annual leave, which includes both those who have worked continuously for more than 12 months at the same unit and those who have worked continuously for more than 12 months across different units. The cumulative working time of employees will be comprehensively determined based on personnel records, social security payment records from the unit, labor contracts, or other legally valid documentation, and the annual leave days will be calculated accordingly. Enterprises are not permitted to deny employees' rights to annual leave at their unit simply because they have not worked consecutively for 12 months. Additionally, efforts must be made to ensure the vacation rights of employees who have not taken leave due to work demands, new hires, employees whose labor contracts have been terminated, and dispatched employees, ensuring that all employees take all entitled leave and timely compensatory leave.
