One piece of information related to the land procedures for the Jinxiaowo lithium mine of Ningde Times triggered a disturbance in the lithium mine market. On June 8, the Jiangxi Province Department of Natural Resources issued a notice to cancel the "Construction Project Land Pre-approval and Site Selection Opinion Letter" with the number "Yong Zi Di 3609002025XS0001571". The announcement stated that the cancellation was made in accordance with the application submitted by Yichun Times New Energy Mining Co., Ltd., based on relevant regulations such as the "Administrative Licensing Law of the People's Republic of China", and the opinion letter would be legally canceled from the date of the announcement.
A spokesperson from the Jiangxi Province Department of Natural Resources told reporters that the cancellation of this opinion letter was a normal procedure and this announcement was just to inform of the situation.
It is understood that the "Construction Project Land Pre-approval and Site Selection Opinion Letter" is a statutory prerequisite document for project implementation. An expert familiar with land investment told reporters that this opinion letter is a very early step in the project process, without which subsequent procedures cannot proceed and the land cannot be used. After the cancellation of the opinion letter, the entire project's subsequent land procedures will need to be reprocessed, potentially delaying the project progress.
Another industry expert told reporters that the cancellation of this opinion letter means the termination of the pre-approval review of spatial planning compliance for the project, legally releasing the land use from pre-approval constraints. The "Construction Project Land Pre-approval and Site Selection Opinion Letter" is a statutory prerequisite document specified in the "Implementation Regulations of the Land Management Law of the People's Republic of China" and must be completed before the project is approved. During the application process, environmental impact assessments, mining rights, and other procedures can be carried out simultaneously, but the land use rights certificate must obtain this opinion letter.
Regarding the reasons for the voluntary cancellation by the company, the expert analyzed that there are usually three possibilities: major adjustments to the project plan; inability to implement the land indicators; changes in the investment subject or construction content. After cancellation, the company can immediately reapply, but it needs to go through the entire approval process again, which may take 15 to 30 working days depending on the efficiency of local government affairs. He also specifically warned that unauthorized mining before obtaining the new opinion letter is considered "mining without approval" prohibited by the "Mineral Resources Law of the People's Republic of China".
