Journalists learned on the 12th from the Shanghai Higher People's Court that the Shanghai Higher People's Court, the Shanghai People's Procuratorate, and the Shanghai Public Security Bureau jointly issued a notice, deciding to launch a one-year special operation to crack down on the criminal behavior of refusing to execute judgments and rulings in the entire city starting from May 2026, and legally punish illegal acts such as resisting execution, evading execution, and obstructing execution. According to the notice, individuals who have cases in Shanghai courts but have not fulfilled their obligations as determined by effective legal documents should actively report their assets truthfully to the people's court and voluntarily fulfill their obligations. For any behavior of resisting, evading, or obstructing execution, the people's court will take disciplinary measures such as fines, detention, and inclusion in the list of dishonesty; if it constitutes a crime, criminal responsibility will be pursued according to the law. In cases where the person being executed hides, transfers, intentionally damages property, transfers property without compensation, or transfers property at an obviously unreasonable low price, causing judgments or rulings to be unenforceable; if the person who is supposed to assist in the execution declines to assist after receiving a notice of assistance from the people's court, resulting in the inability to enforce the judgment or ruling; if the guarantor or the person being executed hides, transfers, intentionally damages, or transfers the property provided as guarantee to the people's court, resulting in the inability to enforce the judgment or ruling, it may be considered as constituting a crime, and the people's court will transfer the case to the public security organs for investigation. The notice emphasized that all individuals who have not fulfilled their obligations as determined by effective legal documents must fulfill their obligations in a timely manner. The people's court will adhere to the concept of benevolent and civilized execution, providing reasonable space such as leniency and partial fulfillment to enterprises or individuals in good faith to facilitate execution and reconciliation, help enterprises recover, and jointly solve problems such as wage arrears and triangular debts.
