Supreme Court: Administrative case appeal rate and application for retrial rate decrease year-on-year.
The Supreme People's Court held a press conference with the Ministry of Justice to jointly release the work situation of "substantially resolving administrative disputes and promoting administrative law enforcement in accordance with the law by 2025". In 2025, more than 330,000 first-instance administrative cases were accepted, an increase of 13.9% compared to the previous year. Despite a significant increase in the number of first-instance administrative cases in courts nationwide, the appeal rate and application for retrial rate of administrative cases decreased year-on-year, with a large number of administrative disputes being substantially resolved in the first-instance procedure. In 2025, among the first-instance administrative cases settled by judgment, administrative agencies were ruled against in 25,099 cases, effectively supervising administrative agencies to act in accordance with the law. Administrative reconsideration is a system for the government to rectify its own mistakes and a relief system to resolve administrative disputes raised by the public. In 2025, administrative reconsideration institutions at all levels handled a total of 1.115 million administrative reconsideration cases, an increase of 38.1% year-on-year. After administrative reconsideration, 93.6% of cases did not proceed to litigation or petition procedures, with the "closure rate" increasing by 3.3 percentage points year-on-year. In 2025, administrative reconsideration institutions at all levels continued to strengthen their supervisory functions, intensify monitoring of individual cases, and corrected a total of 72,000 instances of illegal and improper administrative actions that infringed on the legitimate rights and interests of the public and enterprises, with a correction rate of 11.5%; 205,000 cases were settled through mediation and resolution methods, achieving a withdrawal rate of 29.8% at the local level.
