On January 27th local time, the European Commission issued a statement stating that the European Commission has initiated two compliance procedures today to urge Google to fulfill its obligations under the Digital Markets Act. These compliance procedures formally require the Commission to engage in regulatory dialogue with Google on its compliance with the two obligations under the Digital Markets Act. The first phase of the hearing involves Google's obligations under Article 6(7) of the DMA, namely to provide effective interoperability of hardware and software functionalities controlled by Google's Android operating system to third-party developers; the second phase of the litigation involves Google's obligations under Article 6(11) of the DMA, namely to provide anonymous ranking, query, click, and browsing data it holds to third-party online search engine providers under fair, reasonable, and non-discriminatory terms. In the next six months after initiating the procedures, the European Commission will complete the investigation. Within the following three months, the Commission will inform Google of the preliminary investigation results and list a draft of measures to be taken against Google to ensure its effective compliance with the DMA.
