The State Administration for Market Regulation releases an interpretation of the revised "Provisions on Prohibiting Monopoly Agreements".

Article 17 of the Regulations explicitly stipulates the market share standards and other conditions that vertical monopoly agreements not subject to prohibition must meet: firstly, it sets forth the market share standards and turnover conditions corresponding to different types of vertical monopoly agreements. For vertical agreements specified in the first and second items of Article 18, Paragraph 1 of the Anti-Monopoly Law, if the market share of the relevant market during the agreement period is less than 5% and the turnover of the goods involved in the agreement is less than 100 million yuan, they shall not be prohibited. For other vertical agreements specified in the third item of Article 18, Paragraph 1 of the Anti-Monopoly Law, if the market share of the relevant market during the agreement period is less than 15%, they shall not be prohibited, without turnover conditions.
