TechCrunch, a technology media outlet, reported yesterday that Elon Musk's X platform is currently using both legal action and updated terms of service to defend its ownership of the "Twitter" trademark. A startup company called Bluebird Action filed an application with the US Patent and Trademark Office on December 2, claiming that X has relinquished the brand and is attempting to register the "Twitter" trademark. X platform has now countersued to challenge Bluebird Action's claim. In a document related to the countersuit, X explicitly stated that the company continues to exclusively own the Twitter, Tweet trademarks, and the classic bluebird logo. To close any loopholes from a regulatory standpoint, X has revised its terms of service, which will come into effect on January 15, 2026. The new terms explicitly state, "Nothing in this agreement grants you the right to use the name of X or Twitter...," prohibiting users from using related brand assets without written consent. Previously, the terms only mentioned X and did not include Twitter.
