Trading system service providers involved in unfair competition can be reported to the China Securities Regulatory Commission by brokerage firms.
Recently, it was learned by reporters that the China Securities Industry Association has issued a notice to securities firms entitled "Notice on Establishing a Complaint and Reporting Mechanism for Unfair Competition by Information Technology System Service Agencies." The notice states that in order to implement the relevant requirements of the China Securities Regulatory Commission, the association has established a mechanism for collecting complaints and reports on information technology system service agencies engaging in or participating in unfair competition within the securities industry. If information technology system service providers registered with the CSRC engage in the following behaviors and securities companies intend to complain or report to the market supervision department, the securities companies may submit relevant evidence to the association. The behaviors include: 1. Commercial bribery; 2. False or misleading advertising; 3. Unfair competition using technological means; 4. Price manipulation disrupting market order. It is reported that the association will establish a ledger of information about these clues and update it dynamically, regularly reporting the situation of the materials submitted by securities companies to the CSRC Technology Supervision Department. For individual issues, the association will guide securities companies to resolve disputes with the complained or reported party according to contract provisions, or submit complaints to the market supervision department; for industry-wide issues with clear direction and significant negative impact, the relevant entities will report to the market supervision department through complaints and reports. If the unfair competition behavior of service agencies also involves the futures and fund industries, the association will consult with the Futures Industry Association and the Fund Industry Association as appropriate.
